District Attorney Mike Waters has determined that a Person County deputy's use of force was warranted. a fatal shooting occurred last year .
On May 5, deputies shot and fatally wounded Kelvin Markeith Mosley after claiming he was shooting at the sky on a public thoroughfare.
The incident occurred at the intersection of Mount Harmony Church Road and Cousin Road.
When two deputies arrived in response to a call, they discovered a crashed Dodge Challenger lying in a ditch and Mosley strolling down the road brandishing a firearm, gesturing towards passing cars.
Mosely discharged several rounds into the sky and subsequently began advancing towards the deputies. Authorities stated they repeatedly instructed Mosley to halt and lay down his weapon, yet he declined to comply.
One deputy discharged two rounds, hitting Mosley, who ultimately succumbed to his wounds even with emergency interventions.
Once deputies retrieved a weapon from beneath Mosley’s leg, they discovered it was a Glock 19 that had previously been purchased in Durham by someone else.
To conclude, Waters stated that the deputies proceeded by adhering to their training, which was aligned with both the legal mandates for using lethal force and the most rigorous professional benchmarks.
